ON3P received demand to change name of “Great Scott”

This post is meant to inform anyone who has to date purchased a “Great Scott” ski from ON3P, or those who are considering a future purchase.  In late October, ON3P received a cease and desist order from SCOTT USA Ltd., and its affiliates SCOTT Sports SA and SCOTT USA Inc., demanding ON3P immediately cease commercialization and sales of all “Great Scott” branded skis for reasons of  trademark infringement. 

We are current exploring the legality of the use of “Scott” in the name of our ski “Great Scott” and should reach a decision in the near future.

Once we have reached a decision, I will post an update on the matter.

Poor form Scott. Just when you were about to increase sales tenfold by signing Wallisch, you have to go and do this..

And for most of you saying that it's ridiculous, this is probably the least ridiculous of the copyright infringement lawsuits of recent (WME and Hansen) because Scott is in the ski making business with ON3P and ON3P will be making a profit on the skis.

I'm definitely no lawyer, but I'd say that this, unfortunately, could be a valid lawsuit.

guess tom wallish wont be allowed to afterbang anymore because line used that as there skis, or no one can have their suit look g, because the g suit is trademarked to salomon.

Poor move by Scott but it was likely a decision by its attorneys performing typical trademark enforcement.

Scott does not have a strong claim for TM infringement. Scott does hold the rights to the name "Scott" on a number of products, including skis.  However the name "Scott" is not being used alone, it's being used with "great."  Thus, the question becomes whether or not "great scott" is confusingly similar to the "scott" mark.  Most likely not.  "Great scott" is a phrase used in regular conversation and a reasonable person would not confuse it with the scott mark.  That great scott is a common phrase weighs strongly against scott's claim.

Wrong. Wrong wrong wrong. This is by FAR the most ridiculous. Not even close. It is FUNDAMENTAL trademark law that you can use your own proper name as a mark and Scott USA's lawyers know that. They are doing this for the SOLE PURPOSE of using their money advantage as a large multinational company to apply pressure to a smaller competitor. I don't work for on3p but I support what iggyskier is doing and NO ONE should support a company that wants to fuck with the little guy like this. This is every bit as bad as WME vs. Level 1, we are in a tight knit industry and throwing around lawsuits is not above board. I will be sending a letter to Scott USA and I encourage all of you to do likewise, just as you did with WME.

Dear Scott USA,

It is to my understanding that you are demanding ON3P skis to change the name of their one ski, "Great Scott" because it has the name Scott in it. That ski is not meant to have any relation to Scott USA, it is in fact named after the founder of ON3P, Scott Andrus. It is ridiculous that you are doing this right after gaining all this new respect for signing Tom Wallisch. Until Scott USA drops this case leaving ON3P alone I will purchase or support nothing having to do with Scott. I really hope you take this Email seriously and put it into consideration. Thanks.
