Summary of Complaint

The owner of Park City Mountain Resort (PCMR) has filed suit against Talisker Land Holdings, LLC to ensure that PCMR will continue to operate as one of the nation’s premier destination ski resorts. Since 1971, PCMR has used land owned by Talisker as an important part of its ski terrain. On April 30, 2011, PCMR provided Talisker with written confirmation of PCMR’s extension of the parties land-use arrangement for 20 additional years. In addition, PCMR paid Talisker the rent required annually under the parties’ agreement. Between 2009 and mid-2011, PCMR provided Talisker with repeated declarations of its intent to operate the resort through 2051. PCMR also advised Talisker of its intent to make major expenditures for ski terrain infrastructure improvements—expenditures totaling over $7,000,000 during the summer of 2011 alone. In late December 2011, however, Talisker notified PCMR for the first time that it took the position that the parties’ agreement expired in April 2011.

PCMR first asks the court for a declaration that the parties’ agreements have not expired but have been extended to 2051.

PCMR next asks the court for an injunction to prevent Talisker from shutting down PCMR’s business operations. If Talisker is not enjoined, the financial consequences to PCMR, it employees, the Park City community and the state would be disastrous.

Alternatively, PCMR seeks damages for Talisker’s delay in disclosing its intent to terminate the parties’ agreements. With knowledge that it intended to evict PCMR, Talisker continued to collect rental fees, allowed PCMR to invest over $7,000,000 in infrastructure improvements, and participated in discussions regarding a possible interconnect between the two resorts. PCMR seeks compensatory damages in the amount of $7,000,000 plus interest as well as punitive damages.

Fuck Talisker. Not only are they in the process of destroying The Canyons by catering exclusively to the uber rich, treating their employees poorly and providing shitty management and customer service, now they are trying to spread their disease over the ridgeline to PC. I sure hope this doesn't happen and Talisker is forced to back off.

So the entire point of this Tallywackers company is simply to own land and charge people large amounts of money to use said land? And they seem to demonstrate great service to their clients while simultaneously contributing absolutely nothing to society other than pissing people off.

G12 Toronto style, but yea this is horseshit. I've never skied outside of ontario/Qc but one of the place i really want to go is park city, it looks so nice and the park is always on point in all the edits i've seen. Ill do whatever i can to keep this place open forever!

did anyone else read the Q&A? they used this canned response as part of their response like 3 times

i also find it interesting that they claim they dont know what Talisker wants? and that their offers have been more than fair?

and before everyone goes!!! OMGGZZ save park city!!! and keeps on being ignorant think about this. they are NOT going to get rid of one of their biggest money makers, and they know the park at PC is an influence on who will go on vacation/move here et cetera. so just think before you try to go all KONY2012 on this mother fucker. but if this is what it sounds like they are trying to fuck PCMR out of money they allegedly already paid, and that just sounds like bad business. if that's their business model then they won't stay in business long.

I'm probably about to catch some serious hate, but the way pc's been runnin this year has not been on point in my eyes. Them and POWDR are actually really starting to piss me off. If the mountains closed next year, That'll be some very simple and very rad slackcountry. If talisker adds it onto the canyons, that'd be one ill euromountain with all the expansion they're thinking of. I dunno, big corps fighting big corps, either way my voice doesn't mean shit, so might as well look at the plus of whatever is to come.
