DUI help.

Alright so the other night I got a DUI, I turn 21 in 6 months, I blew a .007, off of 2 beers. I was high as well, and the cop cited me for both alcohol and marijuana.

any advice on how I should approach my court date?
i've heard of a Plea in Abeyance, but several people have told me to not do it,

legal advice much appreciated.

lol. im not going to continue this arguement at all but for the record ive partied hard my entire life. I overdosed on some other drugs, but used to buy weed in qp's. I smoked roughly 1/4 oz everyday to day and half for about 6 years of my life. I no longer do any drugs after overdosing on some other stuff but dont rain on anyones parade about drug use... I encourage drug use to get out there and experience life in different sets of circumstances other than the "sober" mindset but never will i suggest a friend even take a single haul and drive, its beyond reckless. This thread isnt about if driving high will effect his driving habits, its about him asking for legal advice... so lets just drop our arguement, you feel the way you do and I have my own standpoint.

Hahah yes... I'll admit it... I'm not a great driver. I'm not terrible, but I definitely have my flaws, especially in the focus area. However I've been told numerous times that I am a much betterm alert, and even a good driver after I smoke.

First of all man, stop being such a douche, there would have been a lot better ways of getting your point across then calling people idiots. Especially the OP, who in my mind did nothing wrong. Sure there are points when someone is too high to drive, just like you can be too angry, or too tired to drive. Im with the kid who posted above me. A person who has built up a tolerance for THC, and who is used to the effects of marijuana can drive safely while moderately high.

That being said I also want to kick people in the nuts whenever they say they drive drunk. Drinking impairs your motor skills so much that doing anything active really drunk isnt safe. Why is it that I cant huck cliffs super drunk, but I can smoke a couple of blunts and then go shred? Its because being high, if you are used to it, really doesnt impair you that much. I think for most people what is most impairing, isnt being high itself, its thinking "oh im high" and not focusing on the task at hand.

So please, its only a couple months into summer, please stop being such a douche.

Agree to disagree. Sorry to hear you OD'd I've dealt with that with some close friends shits rough. Respect and there is no other way to smoke weed than a quad a day everyday. It's the way it should be in murrica.

you betcha. I had 4 seizures in front of my mom almost as soon i walked in the door of my house, one caused me to fall face first down a flight of stairs. I dont regret anything though, i loved my time I had with drugs but it was time for me to move on. Who knows, maybe someday you will experience something similar.

No I was perfectly fine, I smoke pot regularly and know my limits with it. I'm not some high school kid that doesn't know how to control themselves when high. he said he tested me because he smelt alcohol on my breathe when the 2 beers i drank were over an hour in advance prior to getting pulled over. When taken to the jail he said " i'm sorry, you seem completely sober and in control of yourself and aware of your surroundings, but i'm required to cite you by law. "

i fully know how thc works. I was being a douche but i feel strongly on this topic because I have been around it for a good chunk of my life. The fact you argue that the body builds a tolerance to THC is true, but the end result is the same... If you are even slightly effected in a single second delay for whatever reason ( THC SLOWS BRAIN THOUGHT PROCESS)... you are now an impared driver, make sense? It may never see a problem with some people but it is literally like rolling the dice every time you do it... that delay of a second may never come at a time where you need to make a clear snap decision, but the chance is there that it will happen one day when you needed a clear thought to get made at that very second.... The chances are low, but why even take a chance? This is what i am saying.

The fact you argue that THC builds a tolerance therefore people should be allowed to smoke and drive is kind of funny because...... alcohol builds tolerance aswell, should you be allowed to booze heavier because you can drink like a fish?

Imagine you had a child.. and he was new to driving... ( less than 10 years behind the wheel) would you want him to have ANY hindering factors in their driving no matter how small they may be? You will never argue away the fact that THC effects the body and mind, people react different to these changes but they are STILL there.

yeah not arguing against your overall point point but weed is classified as a hallucinogen. ever smoke and feel like time is going slower? technically it does have hallucinogenic effects. no your not gonna trip out like on acid or shrooms but it does alter your perception of things. as for the driving high though it is definitely no where near as bad as driving drunk. alot of times when im stoned and driving i find myself going like 5 under the speed limit, but am i as focused on the road as i should be? thats debatable. I have definitely felt like i am too high to drive safely sometimes though which is not cool. overall i would say if it can be avoided thats the best option but at the same time everybody should know their limit and know when its a good time to pass on driving, just like when your drinking.

wrong , people actually drive slower and safer when they are high and more law abiding, but only if your a good driver already . if your bustop kid that drives sketchy and durp alot you would probly suck

THe amount of idiocy in this thread makes me cringe.

I don't care how it 'doesn't effect you' Weed puts you in an altered state of consciousness and in that impaired state you shouldn't be driving even if it seemingly has no effect on you it still does. It doesn't matter if you drive slower although if you're going to drive high that's the best option, but your reaction times are still impaired. To argue that it has no effect doesn't make sense, if it doesn't effect you why do you smoke weed?

The same reason 'drunk driving' is illegal. The legal drinking limit here is .05 which is the equivalent of two beers. Not many people I know feel impaired by two beers however their reaction times and other things are impaired because they're in an altered state of consciousness.

You may not notice it and still be a safer driver than bad drivers but it is still unsafe and illegal.

Out of curiosity, do you have any experience with this? I ask because that is terrible advice. Sure you'll probably end up paying more for a lawyer than the fine will be, but you get what you pay for. DUI's incorporate a whole lot more than a fine. And the laws differ from state to state so saying that he'll lose his license for "probably 30 days" is most likely not very accurate.

OP definitely get a lawyer, at the very least go talk to one. They'll be able to help with the amount of community service you'll get, time of suspension, possibilities of getting permits so you can still drive to work or school, length and kind of probation you receive, all sorts of shit. The whole legal system is just one huge game so having a lawyer that knows all of the ins and outs of the system is smart.

Also, get as much community service and classes completed before you go in front of the judge as possible. It shows that you're not taking it lightly and that you really do give a shit. Definitely take this shit seriously, it's going to really suck but you'll get past it and learn from it.

as for the weed argument, i used to drive high as fuck all day everyday and never wrecked or anything. it definitely doesn't make you a better driver though...

lol i can think of times on the highway doing 55 just thinking holy fuck we are hauling ass right now. or just doing absolutely retarded things like stopping at green lights, and generally doing some pretty funny shit. now if i was holding i was way too paranoid to fuck up that stuff lol. never been pulled over or anything.

i know for a fact that if i can drive 100 on a road sober, i could do it at about 60 stoned and 80 just high. now i'm thinking you guys mean "better driver" by the fact that you obey all traffic signs and do all of that shit, but that's just a more cautious driver...not better. anybody who says differently is a serious fucking retard.

now i get randoms for my school/job so no more bud for me. however, K2 and all that shit is where it's at for me right now. although it's not too good for you. i watch when i drive after smoking some of the good shit like that. tried driving on "pure evil" and honestly thought i was fucking wasted. couldn't stop laughing for prob 5 mins, just hysterically losing it. good times lol.

usually when i drive anymore it's just around town (small town) and on back roads having a good time driving my car taking in the scenery and driving. not much that's better than that!

oh and i've smoked my fair share of bud as well, definitely not an idiot when it comes to it.

yep, it's pretty ridiculous how times have changed within only one generation. i hear countless stories from my dad, uncles, and their friends about "back in the day" lol. getting caught then was a simple ride home if you're drunk, put the joint out on the ground and leave, or whatever it was that you were doing. nowadays, if you make one mistake you can easily ruin your entire life...pretty sad

Smoking makes me a better driver most of the time. Obviously, I smoke too much, I can say that it negatively impacts my driving so trust me, I'm not leaving that out.

In November '09 I got a UPM, so I stopped smoking for a month. At the end of that month, I got into my only accident, totaling my 'new' car. I was being a careless, impatient driver, and that's where it got me.

I started smoking again that night, haha.

I drive like an asshole sometimes. As a new driver, I was the kinda person that passes everyone that wasn't going 10 over.

I also get into a panic state at times... it's hard to explain. It's kinda like if I miss a turn, I shut down all skill and become a terrible driver until I know I'm headed in the right direction.

I feel like I have some kind of problem with anxiety and impatience, and smoking relieves that. I drive the speed limit, I give other drivers lots of room, and I scan the road like a tigershark. You, my therapists (lol), and everyone else can try to argue with me, but I am crazy as fuck and smoking tones that down.

I'm going to go on the record as saying that OP is a dumbass, and also

pics or it didn't happen on the .007.

There are zero tolerance levels of .01-.02 for several good reasons, mouthwash and cough syrup, being one of them.

I'm assuming that OP is just as bad at math as he is at life and it was really .07, in which case he was close to the legal limit in lots of states.

DUI is stupid and it depresses me that you are this close to being an adult and don't know better.

Bend over and lube up OP. I hope the legal system gives you what you deserve.

Also, I do have experience because a friend of mine was in a very similar situation. He got pulled over for speeding, and the cop decided to breathalyze him... he blew something like a .009 and got a court date. He got away with a 30 day suspension and a small fine. Maybe he's incredibly lucky, but I was just sharing what I knew from an experience.

Where are you getting your statistics from? You're clearly not old enough to go to the bars if you think that people don't regularly drive home drunk. I see it every time I go out. I'm not condoning it or saying it's right, but people drive drunk all the time.

this is an explanation of zero tolerance, pretty self explanatory. above you will see a link to a chart of numbers that show very clearly that Utahs zero tolerance is a whopping 0.00. how fucking crazy is that? that means, under the assumption that you are a dumbass, OP blows a .007 in the state of utah at age 20, he can be charged with DUI for...right, in the paragraph above, operating a vehicle with any trace of alcohol in their systems, otherwise known as a BAC above 0.0

as for your comment about being close to adulthood, well, i would consider 20 years old an adult.
