So today I was riding my bike with a friend. We happen to pass this police car. Right before it passes us my friend asked if that was someone's dad that we know. I look at the driver trying to figure it out. However, at the time I had my tongue out (don't ask why). So anyway I continue riding and my friend and I part ways. Then I look to my right and see the cop car pull up beside me. He asks me to come to him, which I do. This is how the conversation goes.

Cop: Do you know why I stopped you?
Me: Uhhh, no...
Cop: I know you know. Now tell me why I stopped you.
Me: Officer, I am honestly unaware of your reason for stopping me.
Cop: If you make me show you the tape of what you did, I will take you home to your parents and they can deal with you.
Me: What?
Cop: You stuck your tongue out at me.
Me: Officer I honestly don't know what you're talking about.
Cop: Yes you do. I have a theory with kids like you. If we catch them while they're young, we can still turn them around. (Let it be noted that I'm an honor student and recently created a full length documentary about Heroin usage for my county and school)
Me: Can I please see the video? (at this point I recall the position of my tongue as he passed)
Cop: You don't have to see it. You know what you did.
Me: Officer, I wasn't sticking my tongue out at you.
Cop: That's it, I'm taking you home. You have a serious respect issue. Give me your name and address.
*I give him it*
Cop: Okay let's go. *Gets out of car, attempts to take my bike"
Me: I'm not getting in your vehicle. Unless you're arresting me, I don't have to get in it.
Cop: Then I'll just follow you home.
Me: Okay...

Long story short, he follows me home and talks to my dad. My dad refuses to take his shit. Basically, the cop left and my dad filed a complaint about him.

Another note, some things were omitted because of redundancy. I also forgot to mention, he pulled into a driveway and talked to me there. The home owner needed to pull in and he held up his one finger and told her to hold on. This cop was a total moron. I have no problem with police and I respect them. Even if I had done that, I'm a kid. He treated me like I had flicked him off or screamed something vulgar at him.

Any thoughts?

On a serious note, does anyone know if there is any law defining when questioning becomes "detainment". I had to listen to his BS for a good 7 minutes, and he had no legitimate reason to even question me. I understand police can randomly pull people over, but is there a limit to how long they can talk to you? I tried to look it up and I found nothing.

as soon as an officer stops you if you are on foot or on a bike ask him, "are you detaining me, or am i free to go?" and he has to answer you.

I also have no problem with people who are cops but it seems like for the majority of cops as soon as they get their badge they think they are all powerful and use their authority like douchebags

eh, sounds like the cop was probably just bored. Good job keeping calm though otherwise it would've probably gotten worse.

Chances are nothing will be done to teach this cop that maybe terrorizing kids isn't the best use of his time. I've talked to a few of my friends and the general consensus seems to be that he acts like this all the time, and they've complained. My friend was once biking home from someone's house at around 10:30 PM and the officer questioned him. He then followed him home. He also often treats skaters like criminals. Once some of my friends were skating at this ledge and he pulled up and nearly arrested them all because he claimed he had told them before they weren't allowed to skate there. Keep in mind there is no "No Skating" sign in the area...

1.) I am very proud of how mature you were during that situation, it gives me hope that i'm not the only sane person in the world,

and
2.) he had good intentions in his own weird way, i'm sure he just wanted too try and make an impact on the way you think because he misjudged you for an ignant punk.

they can talk to anyone as long as they want as long as they have consent.. like stated above the key is asking if you can be on your way if you dont want to talk to them.

otherwise in order to stop you, they require reasonable suspicion, defined as articulate-able facts that would lead a reasonable person to believe a crime is fairly likely to have either been or is about to be committed. this stop allows an officer to only investigate and detain to a small degree. it also allows for a frisk specifically for safety reasons. an arrest requires probable cause, defined as an officer having sufficient evidence that would lead a reasonable person to believe that you are more likely than not guilty of a crime. several factors constitute an arrest. a combination of time, force (like the presence of an un-holstered fire arm), and even wording. its very subjective and there can seemingly be an infinite amount of circumstances that make all the difference. but like stated before, just ask if you can leave/am i under arrest?, which in order for it to be lawful, they have to tell you that you are and why

literally almost nothing. when your punk ass tries "get away with shit" the long, robust dick of the law will fuck you in the ass likes its san quentin.

Be polite, ask if you can leave, and let your lawyer worry about the rest. Dont consent to searches unless you obviously are hiding something, in which case, try and make nice with the cop.

If you piss off a cop, they will find something to cite/arrest you for. dont be a little punk spouting incoherent shit about your rights.



But if you still wanna learn you some law, then Google is your best friend.
