refusing a breathalizer is only smart if you are wayyyy over the limit. It is typically a manditory liscence suspension and misdimeanor charge, however if you blow a high enough BAC it becomes a felony (so refusal can keep it misdemeanor).
The only true way that I know to get out of a DUI/DWI is (DWI has become synonimous with Alcohol and DUI has been used for under the influence of anyhting in Mass), before the cops puts his/her lights on, shut off the car, keys on the floor, get out and lock the doors. Then when the cop asks what you are doing, say I just realized I should not be on the road, they will give you public drunkeness and abandonment of a vehicle (and a ride home or to the drunk tank).
As far as Accidents (like bumping a parked car, little accidents), leave the scene (I know this sounds fucked up), go call the cops report the accident (to avoid the leaving the scene charge), then hit up a bar and walk back to the scene. You then have witnesses about you having a drink at the bar, and they cannot proove you were drunk at the time of the accident.
If you have had too much to drive and feel like passing out, DO NOT PUT YOU KEYS IN THE IGNITION, put em on the floor, and lock the doors. If the keys are in the ignition they can get you for OUI (Operating under the influence) with the car running or shut-off.
These are not easy to get away with, so best bet, if you are drunk, don't drive.
A lesson for all you kiddies out there. Going out drinking until 4:30 is a bad idea when you have to be up for work at 7:30.
