Doesn't seem right that the guy who got smoked by some asshole isn't entitled to compensation for such incident, it's just unfortunate that the dude got hurt, but that's a risk you take trying to weave between jerry's at high speed.
And on top of that you think the ski resort should be liable for this? If some dude gets smoked and is hurt, the ski resort's waiver should just make this okay and everyone moves on? Dude come on.
the amount of $$$ he wants is kinda weird but this is like the only time a skiing lawsuit makes sense
Ski area law suits are a junk show these days. You can sue for anything. There is no waver. You don't sign for shit. The amount of ass holes that sue for just about anything is amazing.
I don't see the issue.Skier skis reckless, hurts someone else, and was held liable for it. I'm all for going fast but the uphill skier does have responsibility, unless the downhill skier is merging.

You would be amazed at shit that people sue over. Most of the time it gets settled out of court. The big ones go to court.

There is waiver language on the back of the ticket but from what I've heard that stuff doesn't hold up very well when things actually happen
anyway, i think that text is more to do with trying to free the hill from liability. probably no one will try to tell you the USA isn't sue happy, and this dude is asking for too much IMO, but you can't just make a ski hill a lawless land haha. each case will just need to be dealt with separately

Thats what I said, maybe it was confusing there, but the bottom line is if you hit someone and hurt them, you are liable. Some people will be cool about it, but some jerry ass hole on vacation will probably sue you.

But 250K is excessive. Like I know the dude should be liable for the incident but that's just insane.
The waiver protects the ski are from you, the user.
In this case, one user is suing another user .. so the waiver that protects the resort has little to do with it... If you cause a similar injury to a person on the street, I think the settlement would be similar.
250k seems pretty reasonable. fire fighter can make huge cash, over 100k / annum... lost wages, medical expenses and legal fees .. not to mention the trauma associated... if he was a dentist the settlement would have been even higher.
