i dont think they are. when you downloaded them off itunes or upload from a cd i think theres a drm file embedded in them or something (data rights management) that says thats its a legit song...and not one off limewire....but i could be completely wrong

That is true. Thing is, many people use the .mp3 format, which strips off all the DRM. If you legally own the song, you are allowed to make .mp3 copies of it. So unless they have a complete record of all the music you've ever legally owned, it's impossible to know if an .mp3 was downloaded illegally.

The thing about all these new laws/acts coming in is a lot of them conflict with existing laws (such as human rights, as you stated). Also, the EU are against this act I think, so expect the EU to be on our side.
If this act is passed, it will cause a lot of fuss worldwide

exactly. if they pass this law and you get in trouble, take it to court. this kind of stuff conflicts with so many laws that have already been passed. constitutional laws as well. i'm not a fucking lawyer, but i'm pretty sure the case would get dismissed.
and fuck that, if they touched my laptop going through airport security i'd flip shit. i don't know how they can just take your laptop i mean if you're going on a business trip and need it or something you're fucked. either you miss your flight, or are stuck without a laptop for the trip. unless i'm missing something.

Hah. I remember one time when my dad was coming back from a hunting trip in Alaska, he brought his hunting backpack with him as a carry-on. When he get back to NY and was cleaning out the backpack, he found two loaded shotgun shells that he forgot to take out. If security can't figure out that my dad is bringing ammo on the plane with him, I highly doubt they'll be able to scan my ipod and tell me that i have 1,289 illegal songs on it.

im going to start a chain of hotels that are all bulit adjacent, or possibly within, major airports. In the next few years they will prbly produce enough revenue for me to make a decent living. they could plug your ipod into a computer their to see if songs are illegal
these searches are going to be random searches though. not everyone gets searched, this act simply gives customs the RIGHT to search your ipod/phone. chances of you being caught are probably still low, or bring two mp3 players, like a shuffle or something with all legal music on it.
