apparently though - and this taken from the Denver Newspaper...the man who was hit was pretty injured...and wanted some compensation for his huge medical bills...which still sucks - the whole situation, but it kinda offers a little more of both sides of the story..
He was taken to a local hospital, where his shoulder was immobilized. He returned to Pennsylvania, where he underwent surgery for a torn rotator cuff and a procedure to repair part of his clavicle, the lawsuit states. Since then, he has undergone "extensive" physical therapy, according to the lawsuit.
Chalat said Pfahler sent a letter to the Swimm family after he returned home, asking them to help pay his $35,000 of medical bills. He never heard back, Chalat said.
Suing isn't there for people to recover losses they incurred, and shouldn't
be used as such. If someone is legitimately in the wrong causing harm or to the
other party, then sure, sueing is appropriate. Doing so because you can't afford
your medical bill isn't. But what do I know? People don't sue for ridiculous shit here.
Isn't that why you have health insurance?
