WME Legal action put on HOLD!!!

If level 1 wins this case (which I originally thought they didn't stand a chance, but now hearing that the contract between Warren and WME expired long ago has significantly changed that), they will almost for sure be able to sue WME back for damages on a false claim and it's quite possible (depending on the judge) that some punitive charges will be tacked onto that for obviously trying to bully around a smaller company on no solid grounds. 

This could get pretty ugly for Level 1 though WME might be able to push this to the point where they litterally don't have the funds to pay for the trial process

Weighing in.  That sounds like a typical non-compete clause.  The longest one I've seen in any industry is 5 years.  Warren Miller has a right to make a living in his professional field.  His voice is his livelihood.  I don't see how any judge can side with WME.  Take Gart Brothers.  The actual Gart brothers sold the business which is now known as Sports Authority.  They had a non-compete which prevented them from opening another sporting goods company for about 5 years, I think.  Now they own sporting goods stores again.  I think that Sports Authority still owns the rights to the name "Gart Sports". 

I think this pretty much boils down to the fact that the print media is dying.  Ski and Skiing magazines are selling fewer subscriptions so they are in a defensive mode.  If anything looks to threaten their business, they feel like they have to go after it.  Kind of the last throws of desperation.  The only place I see Ski or Skiing magazines laying around are in the Doctor's office waiting rooms.

Care to explain how Level 1 will make "killing" after having to pay lots of legal fees etc? On the contrary, I think level 1 will struggle financially regardless of whether they win or lose

hopefully the backlash they recieved convinces them to just drop it.

Bros are immune to law enforcement, therefore warren miller is immune to law inforcement, and bros roll deep, so miller kicks it with berman, crashing parties and grinding slampieces and shit, so Berman is immune to the legal actions as well.  not to mention bros are smart as shit so berman is untouchable.

SEATTLE, WA. (October 13, 2009) – For so many of you who may not already know, I would like to clarify that I am not, nor have I been involved with Warren Miller Entertainment (WME) or their ski movies for quite some time now. When I sold the company to my son in 1988, I was excited about staying involved and helping carry the company forward. However, the company has twice since been sold, and it has been six years since I have had anything whatsoever to do with the films bearing my name.

The lawsuit that WME has filed against Josh Berman and Level 1 Productions is something that never should have happened. WME has no valid claim for Trademark Infringement, and that is why they are attempting to delay the action with Level 1 and go to arbitration with me. The judge will rule on the stay of action sometime this week. For Josh and Level 1, a stay of action only means that WME gets to put off their lawsuit, until the arbitration between them and me is finished. That is unacceptable as it leaves Josh and Level 1 hanging in the wind.

I stopped working with WME because our ideas on what the ski films should be weren’t on the same page, and they demonstrated that they didn’t want my involvement in making ski films any longer. WME’s statement that they “would like nothing better than to have Mr. Miller be a continuing part of WME,” but cannot because they are “a small company with limited resources and we are not in a position to meet the financial conditions Mr. Miller requires” is really absurd.

I have never made ski films solely for the money. I have always done what I do out of my love for skiing, passion for people, and the freedom that I find while on the mountain. I sat down and did an interview with Josh, a friend whose entire company, Level 1 Productions, generated less than $100,000 in revenue in 2008. While on the other hand, WME is the largest company of its kind in the world and is part of a multi-million dollar corporation, which is owned by a larger global conglomerate that posted more than a billion dollars in revenue in 2008.

I am really flattered by how much support so many people have shown not only to me, but also to Josh and Level 1 Productions. Thank you for reading this. Let’s all look forward to bluebird days and untracked powder snow!

Well, if Level 1 does happen to lose a lot of money on this bullshit, the ski community will bring WME down, and next year, Berman will make the sickest roadtrip, no budget, hobo skimovie ever, and it will totally kick fucking ass and everyone will love it and buy a 1000 copies each, and then next year after that, he´s back at it again.

Simple.

Go take a muffin WME, Level 1 owns you.
