a couple people will get fucked to make an example, then the number of downloaders will drop, but then people will start downloading again after they stop hearing about the trials. same exact thing happened here 6 years ago.

technically, no. But if caught, you will only be prosecuted under civil law, not federal. So no prison if your caught.

This doesn't really make sense. Civil law pertains to interaction between citizens, rather than between the government and citizens. So clearly it's not that. Do you mean that you'll be prosecuted under provincial rather than federal law? Because that would mean that the offense isn't criminal, just regulatory (provinces aren't allowed to enact criminal law, it would be unconstitutional). I really don't know much about the nuances of our marijuana laws.

If this actually passes, we (internet users in general) will be totally fucked because the only way they can inforce this is by getting all the ISP's in Canada on board. And if it ever gets to that point (where all the ISP's have t band together under the gov't) we are going to see a brutal monopoly/regulated internet which will suck some serious balls.

I guess most of you are too young to remember the days when the was no such thing as bit torrent and limeware and napster. There once was a time when the only way to get music was to buy it. The free ride can't last forever. I'm surprised it has taken this long. That being said, if you actually read into this bill most closely, you'll see that it isn't as bad as the one currently in place in the US, AND if you are just one guy downloading songs for personal use, chances are you won't be prosecuted. However, if you're downloading 50,000+ songs, maybe. They bill is being enacted to crack down on those profitting from illegal downloading as well as chronic abusers, not really your average person.
What is really stupid is senator Larry Campbell is trying to enact a bill that will ban the NFL from Canada.

thats reasonable then. I cant see how they could effectively track everyones downloads anyways...the volume would be near impossible to go through automatically with any sort of accuraccy.

no. technically it is illegal and will always remain illegal in canada (lets avoid that argument here) You are talking about it becoming decriminalized which has not happened and will not happen under the current government (possibly under the next liberal government) If you are caught dealing obviously you wont be prosecuted criminally and face large fines and potentially a long prison sentence. I dont think thats what you were talking about but it had to be put out there. As for possession, that is still a criminal offense regardless of what province you are in. However they are getting more lax on it in certain provinces so often police officers use their discretion more often and choose what they believe is the more appropriate option. You could still face jail time or large fines or because the courts are backed up you may just have it confiscated if its your first time getting caught. Some provinces this happens more than others. But it remains illegal and you can face prison time. But yes the route most often used is confiscation or fines with potential for criminal record. I know many people who have gone down all these roads, very few actually face jail time though, about 1/3 got fines and a criminal record.

ooops, and with regards to this thread, there will probably be a lot of loopholes and could have a lot of scrutiny such as if someone gets songs from places canadians dont have the legislation to enforce. a similar example is them shutting down poker sites in the US. Now most people who do that go onto european poker sites. Because the US has no jurisdiction over there.

Guys, don't forget. This is still simply a bill thats been proposed, nothings set in stone yet. It still has to pass a vote in the commons where the government is in minority, and make it through a very liberal Senate.
With the Scott Brison (Liberal Industry Critic) raising as much of a stink as he is, it will probably rally the opposition to vote against it, Libs and NDP are looking for any excuse to snub the Conservatives nowadays.
