NYS Liquor law...unconstitutional??

I don't know if other states have similar such laws, but New York State has a law concerning the sale of liquor on Sundays. Liquor can not be purchased prior to 11 am on Sunday mornings alone. This law obviously has a direct connection with religious services and whatnot. The thing i don't understand is, how they can get away with this law? There must be a distinct seperation between church and state, and this law clearly goes against that seperation. Unconstitutional, correct?
If anyone came come up with a decent reason as to why this law is constitutional (from the legal standpoint ofcourse, please tell me.

im not sure but ohio is the same way i work in a grocery store and that is the only wierd time like that when you cant buy alcohol so maybe it has to do with church

seemingly bery inconstitutional, but voted into law everywhere. It is 2 o'clock here, and that really sucks balls. There are places that sell early though ;)

i think it has something to do with being voted by citizens it affects though, there is no way it would just be put out there like that

in ontario you can't buy liquor anywhere be it bar or store before 11. how 'bout that.

I could maybe see the justification in that law being an every single day law. Because then you could argue that if people could get liquor earlier, they could get much drunker, earlier. However, only sunday mornins shows a direct link to religion.

Yeah, In Minnesota it's like 2 too. I'm pretty sure it was just voted in that way. And I guess as long as it was voted and the majority supports it it is void of the seperation of chuch and state.

It doesn't matter what the people think, the Supreme Court can strike it down as unconstituional and the law will be null and void. If the people want to go around the Supreme Court, they can amend the Constiution.

in colorado you can't buy booze at all on sundays. Cept in the groery stores and it's like 3.2 beer.

Get the ACLU on it if you really wanna do something about it. But I don't think that you have a real good case against it because the State is telling you to goto church or believe in god. They are just saying you can't buy alcohol before 11 a.m. on Sundays.

nah drunk people at church are funny...my grandma use to do that all the time...well ok...she just drank boxed wine, but she still went tipsy

It's the elastic clause of the Constitution that allows the government to pass laws like that. Actually, without the elastic clause, our government would be a LOT less powerful than it is now, but it allows lawmakers to justify in the Constitution what they are doing.

I live in pa, and work at a grocery store, but we dont sell alcohol, so i dont know if there is such a rule, but why does it matter. If you already have alcohol you dont need to go out and by some at before 11 anyways, sounds kind of stupid to me. Pa might have that law, but i have no clue if they do.

its just a law thats been around for a long time that no one ever realy cared to change anyway...because it realy dosent matter....

ya, out in Vail we got stuck with no booze on a sunday and had to resort to buying 3.2% beer from the convenience store - it sucked ass. BOO.

Nope, alchohol is a controlled substance and the sale and distribution can be regulated. I take it the Liquor law is a Blue law?
