He was responsive in replying, but did not do much to actually recognize that he made a mistake. There was no apology. He did show one link for someone looking to buy the pants (not "many ways"), but I wasn't trying to sell, I was looking for him to recognize that he'd made a mistake and acknowledge that he would be more careful in the future.
In terms of resolving the issue. He said that a rep gave them to him and that I could try for warantee. However, this does not make sense because warantees only work with proof of purchase from an authorized dealer. He also said that the pants may be a "factory second." When selling, one should always check for condition... check for possible reasons why it may be a second rather than passing it off and new and perfect.
Price is not the issue and has nothing to do with why I am bringing this up.
Saying the pants are of poor quality is not an excuse for not accurately stating condition. Yes wear and tear happens eventually, but I like to receive things I buy in the condition stated.
In terms of being put on the BAD list, like I said I was hesitant to bring up the case because Bp. has a solid reputation on the site... and note the last few lines of what I said before...
"He did refer me to people who were looking for the pants in case I wanted to sell them, so I don't think he intended poorly as a seller. I'd just recommend anyone who may deal with him in the future to make sure he is being up front about the condition of the product being sold."
So I think it's totally Rowen's call. I just wanted to make the case known, not necessarily demanding Bp. be put on the list - it's just a complicated case.

Actually, its up to the both of you whether BP should have a bad action sidenote. The way bad actions are resolved and taken off the list is such:
Both members need to publically or privately (via PM with me) agree that the dispute over said item transacted over the site is settled. Both members have to conceed that the name should be taken off the list. Only then will it be removed. Whatever kind of deals or negotiations that go on behind the scenes, both members need to give the OK for the name to be removed. I say both because consent is needed from all members involved in the dispute.
(I realize that by this, people can pull the asshole card and give someone a bad rap and never agree to let them off the list. However, this is already a trust based system, and if you are found to be doing this with no proof, action will be taken against you through the site admins.)

^ Thanks for clarifying. I'll stand by keeping him in the file then. Honestly, the only thing that kept me back from blowing up was being respectful of his reputation for being a good contributer to the site. He may not be a bad guy, but he really had poor selling practices.
I mean, actually, he didn't ship when he said he would and he didn't give the stickers he promised either. I was going to let those things slide, but I could not go unspoken when it came to the unstated rip and stains.
In terms of considering it resolved, I easily would have if I received some form of an apology for any of what happened. As polite as I was when raising the multiple issues, not once did he apologize. That makes me think he does not even recognize fault in any of what he did.
Two other times I have been involved in transactions where the product had a flaw that was missed by the seller (once as a buyer, once as a seller):
As a buyer: I let the seller know that one velcro patch on a new jacket was only half stitched on. He apologized for not realizing and immediately refunded me some money, telling me to bring it to a tailor to get it fixed.
As a seller: Once when sending 2 tee-shirts to SkierJulie. I noticed just as I was boxing them that there was actually a stain on the back of one tee. I immediately took a picture of it and added an extra Nomics t-shirt to the box and sent both pics to SkierJulie, saying Sorry...I hope that it's okay... and so on.
In this case, I wasn't even expecting as much, just a genuine apology or if i'm lucky a "I'm really sorry. I'll send those stickers I never sent you in the first place your way." would have been nice. Yet, nothing of the sort happened - no acknowledgement of being wrong, no magical word 'sorry.'
I waited 3 weeks before I posted the case, so that was plenty of time for an apology on his end. Now that it's been almost a month, it's a sign that he still feels he has not done anything wrong.
So, I'll stand by my words of caution.

On my end, i Still Feel that the reputation and your Reaction is a bit rash and unfair, Theres a risk from anything that comes from it, I'd also like to mention that my shipping was on time with your order and i stuck to my promise to get them to you on time (upgraded to Fedex 2 day, dint charge you for shipping), and you never told me I forgot stickers, I'm sorry i forgot the stickers.

Actually, the delay in shipping made the difference of 4 days. One major reason why I decided to buy was because I wanted the pants for my last trip of the season. Originally according to FedEx timetables, I would've gotten them Friday before I left. Instead, I got them Tuesday. So, it was still a 4 day difference. Secondly, I did tell mention that you didn't send the stickers in a PM. Nevertheless, like I have said, these aren't the main issues.
What you did with the posters situation.. well that was great, but...
I just don't understand how someone can sell something not in the condition they stated and refuse any fault and completely assume no form of responsibility.
If that is the case, then anyone can sell something to a seller with stains or a tear that they did not mention and then say something like, "Well I sold them to you for a great price so it doesn't matter that it has blemishes I didn't notice! Since the price was good, that totally makes what happened okay of me and I have done nothing wrong. So sell them off to this kid or just enjoy them!"
