These pants were never used, and were bagged until i got them, Where i took the picture, I never wore these pants, but I own alot of oakley gear including pants, and the same size which is how i knew the fit of the pants.

I dont really think it fair to be put on the BAD list, however I do appreciate the concern.
I'd like to clarify on a few of the points above:
He was responsive in replying, but did not do much to actually recognize that he made a mistake. There was no apology. He did show one link for someone looking to buy the pants (not "many ways"), but I wasn't trying to sell, I was looking for him to recognize that he'd made a mistake and acknowledge that he would be more careful in the future.
In terms of resolving the issue. He said that a rep gave them to him and that I could try for warantee. However, this does not make sense because warantees only work with proof of purchase from an authorized dealer. He also said that the pants may be a "factory second." When selling, one should always check for condition... check for possible reasons why it may be a second rather than passing it off and new and perfect.
Price is not the issue and has nothing to do with why I am bringing this up.
Saying the pants are of poor quality is not an excuse for not accurately stating condition. Yes wear and tear happens eventually, but I like to receive things I buy in the condition stated.
In terms of being put on the BAD list, like I said I was hesitant to bring up the case because Bp. has a solid reputation on the site... and note the last few lines of what I said before...
"He did refer me to people who were looking for the pants in case I
wanted to sell them, so I don't think he intended poorly as a seller.
I'd just recommend anyone who may deal with him in the future to make
sure he is being up front about the condition of the product being sold."
So I think it's totally Rowen's call. I just wanted to make the case known, not necessarily demanding Bp. be put on the list - it's just a complicated case.
