The city surveillance video that shows a group of Fullerton police officers beating a homeless mentally ill man to death last year was finally released today, laying to rest any argument that Kelly Thomas was a threat to officers.

The shocking video, which was combined with an audio recorder worn by one of the police officers on the night of July 5, 2011, was shown in court today, then later released to the media.

“Now you see my fists?” Fullerton police officer Manny Ramos asked Thomas while slipping on a pair of latex gloves.

“Yeah, what about them?” Thomas responded.

“They are getting ready to fuck you up,” said Ramos, a burly cop who appears to outweigh Thomas by 100 pounds.

"Well, start punching," Thomas responds, never once displaying any physical aggression towards Ramos.

Moments later, as Thomas is standing while Ramos is ordering him to get on his "fucking knees," Fullerton cop Joseph Wolfe, who is not charged in the case, walks up and starts beating his legs with a baton.

Then Ramos gets into the act and Thomas takes off running, moving out of the frame of the camera.

The camera, operated by a dispatcher at the station, then moves toward the beating, showing Ramos and Fullerton cop Jay Cicinelli on top of Thomas as Thomas repeatedly apologizes and telling them he is unable to breathe.

The cops keep telling him to put his hands behind his back and lay on his stomach, but they are both laying on top of him, making it impossible to even breathe, much less move.

As the video continues, one of the cops can be seen kneeing him.

"Please, I can't breathe," Thomas pleads as the officers keep telling him to put his hands behind his "fucking back."

The cops keep telling him to "relax" to which he responds, "I can't, dude."

More cops eventually arrive and a little more than four minutes into the video, they start tasing him.

And a little after five minutes into the video, as three cops are piled on top of him, beating him, tasing him, one cop looks up at another cop who just arrived on the scene and says, "help us."

At one point he yells out, "Dad, they are killing me."

Even after seven minutes into the video, when six cops are on top of him and all Thomas is doing is crying for his father, they keep telling him to "relax."

Last year, Ron Thomas, a retired Orange County Sheriff's deputy, said the City of Fullerton offered him $900,000 to just go away, which would have allowed the two cops to remain on the force unpunished for killing his son.

Thomas was pronounced dead on July 10, five days after the beating that left him in a coma.

The cops weren't placed on administrative leave as is customary in a death of a suspect until August 2. And only because the community was outraged.

But it's no doubt city and police officials watched the above video that same night. They even acknowledged allowing the officers to watch the video to complete their incident reports.

I guess we should be relieved they never destroyed the video as cops are so used to doing.

During today's hearing, a crime scene investigator named Dawn Scruggs testifed that Ramos and Cicinelli were out of breath and in disbelief after killing him, apparently trying to sway the court into believing Thomas deserved to die.

But anybody who sees the video can see he did nothing to deserve the beating.

Ramos is being charged with second degree murder and faces up to 15 years in prison. Cicinelli is being charged with involuntary manslaughter and faces up to four years in prison.

It is extremely rare for any cop to receive prison time for their crimes.

In the photo below, Ramos demanded treatment for his injured elbow as Thomas lay dying a few feet from him.

While the above video is just over eight minutes long, a 33-minute video was shown to the court today. The other portions of the videos can be seen on this site.

According to the Associated Press:

The video ends with medics taking Thomas from a spot covered with a large bloodstain, while police gather their equipment and discussed the struggle.

"We ran out of options so I got the end of my Taser and I probably ... I just start smashing his face to hell," Cicinelli said, according to the transcript provided by prosecutors. "He was on something. Cause the three of us couldn't even control him."

Earlier in the day, Fullerton Fire Capt. Ron Stancyk testified that he found the shirtless, handcuffed Thomas lying on the ground. His skin was ashen, his hair and face bloody, and he was breathing slowly.

"Nothing was being done," Stancyk, a Fullerton paramedic with 20 years of experience, told the court.

nah for this, i guarantee they will. Cops lose their jobs for stuff like this much more often than they don't. People just remember the times when they don't because they are the exception and it causes more of an uproar. You never see the news articles saying "crime committed, justice served!" because that's uninteresting, and not controversial enough.

well, cops are just people. it's unfortunate to see shit like that happen, but like civilians, there are going to be some honest and dedicated ones, and some corrupt, rage-driven ones. it's nice to see that they wont be getting away with it, though.

sad that he had to lose his life when it was just a matter of subduing him. you should never have to kill someone to restrain them, not with all the training and tools offered today. taze a guy if you have to. worst case scenario shoot him in the leg. but to beat someone to death in a petty attempt to gain control of them is beyond any rational explanation, especially when there are like 10 officers and it's just him, an unarmed skinny possibly intoxicated homeless guy..

as a general rule, if the police are trying to subdue you, just go limp and do nothing. In extreme cases like this one, it apparently didn't work. But 99% of the time, you'll be restrained and thats it. And if nothing else, a video proving you weren't struggling is worth more than anything else in court.

agreed. also, he wasn't intoxicated, complied when they told him to lay down, and was schizophrenic (like many homeless). so sad.

Great response.

I really do think that the article made it sound way worst than the video showed. Just some thoughts from what I saw:

-the fact that the guy was kept saying over and over that he couldn't breathe, meant that he had no problem breathing. It's one of the first things you learn in EMT school, if someone is speaking to you that they can't breathe, then they can breathe.

-I would like to know the toxicology on the homeless man. What, if any, drugs were in his system? It was pretty obvious that the first couple officers were not able to control him. If he was on PCP or some other type drug, it would make sense that he kept fighting. PCP is known to give people almost super-human strength along with completely suppressing their pain receptors.



The video showed police tazering him multiple times, so that was clearly tried. And shooting someone in the leg is NEVER taught in any way shape or form. If an officer pulls his gun to fire, it is 100% to kill. The movies are not real life.

But again, it's unfortunate that the guy died. And I hope that if any criminal charges are brought, that the officers get the punishment they deserve.

Normally you side with the cops? What makes this time any different? Cops beat the shit out of people and abuse their rights all the time its just that most of the time the people they abuse don't die. To me, whether they die or not is inconsequential, its really the principal of the matter.

Is it though? Think about it - The American society we know today places high value on a greater sense of individuality, unlike a lot of other places in the world.

well, cops are just people. it's unfortunate to see shit like that happen, but like civilians, there are going to be some honest and dedicated ones, and some corrupt, rage-driven ones. it's nice to see that they wont be getting away with it, though. sad that he had to lose his life when it was just a matter of subduing him. you should never have to kill someone to restrain them, not with all the training and tools offered today. taze a guy if you have to. worst case scenario shoot him in the leg. but to beat someone to death in a petty attempt to gain control of them is beyond any rational explanation, especially when there are like 10 officers and it's just him, an unarmed skinny possibly intoxicated homeless guy..

Its unfortunate because I see some of this stuff go down, and its very hard to make a decision in a split second. Sometimes they get it wrong. I hope they pay fairly for their actions. Its not right even in the heat of the moment to make a wrong decision and not have to suffer the consequences.

And to the guy above...we're probably paying for his care dude.

Instead of the officer trying to be a badass by saying he is going to fuck shit up. He should trying being professional, since it is his job.

If i talked to people at my job like that i would be fired immediately.

Also instead have his badass tactics why didnt he just try and cuff him at first instead of messing around by telling him to do stuff threatening him and hitting him.

if a cop tells me to lay on the ground and put my hands behind my back once, i do it. this man was clearly not complying. you shouldnt have to tell someone that many times to stop resisting and to put their hands behind their back. he could clearly breathe just fine. when he first got up he clearly put up his fists towards the first cop...none of us are trained to determine whether or not anything done here was excessive. its unfortunate that someone died, and im not advocating the way the cop was talking to him at the beginning, but none of this would have happened if he had cooperated from the beginning.

this "split second thing" is overrated. especially in this case it has NO place whatsoever.

My friends dad is a firefighter. He has had a few guys that took four or more of them to hold down.

And my friends dad is a freaking beast that i wouldnt want to mess with and he said its amazing how strong he said these guys are when they are on drugs.
