Why is Lvl1 asking for audio from IF3?

i read this on my facebook stream a couple minutes ago, and it confused me. Do they want it for the court case to prove something, or do they want to make sure no one has the clips to publish?

I'm guessing for the case, because they need to prove that their copy of the film hasn't been modified since then.

Seeing as how they didn't ask for photos, I would assume this is for the court case. Specifically, the part where people were chanting Warren Miller's name. But what do I know.

One of the claims that WME made in the lawsuit is that the crowd at IF3 was chanting, "Warren, Warren!" during Refresh. I would assume Level 1 is asking for audio so they can deny this statement.

im not berman's biggest fan (i like a lot of his movies, but its more to do with the riders than his shooting or editing) but this lawsuit is pants-on-head retarded

There were deffinitly no chants of "warren, warren" at the premier. Only cheers when his voice came on in the intro. Hopefully some kid trying to bootleg it on his cellphone got some audio maybe

they are producing a film that has been deceiving their audience for years.

WME is done for, i just hope the film doesnt get changed.

even if people were chanting his name, how would level 1 be responsible for that?

if this is true, the only good response would be to get a group of NSers to chant "level 1! level 1!" outside a warren miller premiere haha

I have been wondering since I first read that... I do not remember any chants, just every going crazy with excitement when his voice came on.

Lets pretend there was chanting... why does the chanting matter.. The dude's first name IS Warren after all.  I see tons of people on his Facebook page calling him Warren, maybe WME should sue Facebook too.  Hell I know a few kids with Warren printed on their drivers licenses.  Throw them int he lawsuit too!

the reason they probably want it is because one of WME's claims is that Level1 allegedly use WM as a marketing tool to sell Refresh by advertising WM's involvement (which they didn't). so if kids were chanting Warren, Warren before the show, or his audio appearance, then that would prove to the court that L1 had pre-advertised WM's involvement.

Its super gay that WME is sueing level 1. But did level 1 really need to use warren miller's voice? I don't think someone should be able to own rights to a person's voice but still, Warren Millers narration is what made warren miller movies what they were.
I'm not supporting WME, im just saying that it was a pretty bold move by Level 1, they were kind of asking for it...

Not to stand up for WME at all because this whole thing is straight ridicules but the question leads back to the mid 1990's when it sounds like Warren may have signed a contract with WME giving them exclusive rights to his voice. WME is now approaching Level 1 for pushing Warren to breach this contract (I don't remember the proper legal term for this...) And I think that if they had just had Warren narrate the movie all would be well, but from my understanding, although I have not yet seen Refresh, Warren used many of the same sayings from his days with WME, which may be a basis for a lawsuit. I think the big question is going to be how specific was the contract between WME and Warren, did Warren intentionally not tell L1P about the contract, and how long the contract was valid for. Once again I am not in any way standing up for WME and I think what they are doing is unnecessary and degenerative to the ski media industry as a whole. I know that I personally will never watch, purchase, or promote a WME film in any way again. Best of luck to you Berman and I hope it all works out well!

I think your missing the point. Its about when the chanting was. If people were chanting "Warren Warren..." before the moving premiere it could be implied that somehow Level 1 possibly advertised that Warren Miller was narrating. I honestly never heard any such chanting and it seems like something that WME could have easily made up to attempt to strengthen their piss poor argument.

So they should go after Warren Miller......but NO they won't do that....that would just make them look like really really really big douche bags (even though they already are).

This makes me sick...WME is a joke that has lost any and all touch with the skiing world...Even Warren himself hates WME....ah this whole debacle is driving me crazy I want to do anything i can to help Level 1. I've got the movie, i've sent emails to WME. If this took out Level 1 i would die. People like PBP/MSP/TGR need to step up and help out. We need a fucking revolution that will destroy the Wal-Mart of ski films.

People like Durtchi need to speak up because he's actually in the WM movie. Any athlete who truly loves the sport of skiing needs to step up and help destroy WME!

I think it's true that some people were screaming in the balcony 'Warren, Warren!', but it was before the movie and it was for Phil Warren not Warren Miller. People in the balcony were screaming famous quebecer's names just for fun because they were pretty drunk.

It is a complete misunderstanding and it proves once again how stupid are WME

I see that, but since this wasn't the world premiere it could have easily been someone who heard from a friend who was at the world premiere that he was narrating it, ya know?  But even so, I don't remember any chanting before the movie started at all.

was IF3 the world premire? cause i thought that it was shown in denver first, and if so info on warren couldve been leaked, same with insiders in the company, so that would mean that even if L1 didnt advertise and there was chanting that would be the source.

I think its time we actually here from someone who actually knows something about the contract between WME and WARREN.

What this is going to come down to is just a settlement between Level One and WME through lawyers and someone is going to get ousted. I talked to my friend's dad whose a lawyer in a district court and he said that it will end up in a compromise/settlement..

That being said, this is just another classic example of the damage of a son running the father's company. Their family life is totally ruined because of this, and the company is ruined because the second generation doesnt have the passion and the vision that warren had, and he is pissed because of it, and he should be

It could be a very awkward thanksgiving for the millers

These are all the points that have been bugging me through all of this.  If WME owns the rights to Warren Miller's everything then they have a contract/paid for it then why didn't Warren Miller tell LP1?  He is old so maybe he didn't drag out the contract?  I've never liked WME's ski movies (boorring!!) so I'm not defending them either but if you own something and paid a lot of money for it, you want to defend that ownership.  That said, why didn't they go to LP1 and Warren Miller long before the release of the film?  Obviously they knew all about it because they were so organized to begin the lawsuit right after the first public showing.  I think WME wants a shit storm and I wonder why.  Why did they wait until the film was released? Why didn't they try and negotiate or whatever in advance? If something is going to irreparably harm your business, why wouldn't you try and stop it before it happens?
