Avoiding a DWI

Im not sure if this works but my cousin says one of his friends did it. If your over the legal limit and you get pulled over by a cop, you take the keys out of the ignition, get out of your car, close the door, and chug a beer right in front of the cop. that way if he gives you a breathalyzer(sp) test and you show that your over there's no way for the cop to prove that it wasnt from the beer that you just drank in front of him, and since you werent driving when you drank it its all good. right? maybe?

You'd get an open container citation. I'm not sure if the rest of it would save your ass. You'd still probably get a reckless driving citation too or something along those lines.

you wouldn't get anything for open container if you have a bottle openr on you. But for one thing you wouldn't be able to drive home, and also the way cops are he'd probably get pissed and jsut bust you for something gay.

thats the dumbest thing i have ever heard!! First your a dumbass for driving after drinking and should get whats coming to you. Second I am sure they can get you for something else instead (open alcohol in public, open container ina vehicle etc etc) which either way you deserve for being stupid enough to try that. but try it out and let us know how that works for you buddy

he'll arrest you, take you back to the station and do a chemical test, where they take blood. Then you will get a dwi, and if you are driving drunk you deserve to get caught and lose your liscense

ok is it just me, or am i the only one that realizes if you're driving drunk, when you do a breathalizer your BAC will be much higher than it should be from one beer.

I see this heaps esp up in Whistler, that people would not even dream to drive when they are drunk, but then are more than happy to drive when they are high as a kite. Or even slightly stoned/burnt out.
Same difference.

people drive with alcohol in their system all the time. dont be so vain. ive drivin with a few beers in me and i cant even feel them, my judgement is not impaired, nobody is going to die because of me, BUT i am still over the legal limit. so if i do get pulled over for whatever reason i really dont feel like getting a DWI. if you all werent 12 and 13 year olds youd understand this. sorry for bein such an asshole but you guys are ridiculous.

all you do is pass the field sobriety test and refuse a brethalizer..they will take you back to the station, but they have no concrete proof of you being drunk or somewhat impared if you dont appear to be and you will get a much lesser sentence.

as for the driving high thing, it makes you react differantly than A. it makes your reactions slightly slower (no where near A.) and it makes you over careful. no drivng on very busy streets when your high is not good, but empty or not busy resedential streets are not a problem.

Ok in ever state when you get your license read the piece of paper you sign it was 'For refusing a breathalizer test you can lose your liscense from 90 days up to a year. My friend got a DUI and never even lost his licsense so you take your pick.

yeah my friend's brother refused a breathalizer and now he rides a bike to work. and tori, smoking pot does not slow your reaction time to that of a snail. people would get injured walking down the street stoned if that was the case.

This girl around here refused a breathlizer, and was taken back to the station. She got another test there though, but by the time it was administered she was sober and under the limit, so she fought it in court and won. This was in Michigan though, and I think the laws on drunk driving are differnt in every state, so different things may happen. But on another note, I drive drunk and have not yet been in a car accident, and when I do you all can say 'I told you its bad to drink drunk asshole'.

whoever said that dont know what they are talking about. i have driven heaps when i have been smokin, and i drive perfectly. but when i try to drive drunk i am a lot worse. my reaction times are fucked up when drunk, but pretty normal when smashed

best way to avoid it is to not drink and drive! i know this isn't always the case though. if im out with my buddies or parents and im drivin i limit it to 2-3 drinks depending on how long im there for.

does anyone know what the legal BA limit is for minors driving? Last night i was driving out to a party when a cop pulled me over for having my front windows tinted. Apparently he smelled beer in my car so i had to do all the stupid sobriety tests and take a breathalizer. I hadnt been drinking for the last hour so I ended up blowing a .013, which is pretty much nothing at all. I also had a case of beer in the trunk, and the cop said he would 'let me off' with an MIP and a ticket for the window tints. I know im a dumbass for driving, but could i have gotten a DUI for that low of a blood alchohol level? also, whats considered reasonable proof for a cop to search your car?

In Michigan its anything over .02 for a minor is a DUI. And reasonable proof to search your car is anything really, especially if he smells beer, cops can pretty much make stuff up and search your car though. My friend just got an Mip and blew a .07 and the other blew a .16.

.02 here in mass i think. and they are real strict about it. jail time, loss of license, minimum fine of 500 for first offence. id recommend not doin it, only cuz i know ppl who have died because of it, not those commercials as true as they are. but driving while high is fine by me, you are pretty concentrated on the road.

ya about the refusing the breathalizer thing my friend did that and got it lessened to a speeding ticket but maybe he had a good lawyer, and at least u cant get jail time, here a DUI has mandatory jail time..

refusing a breathalizer is only smart if you are wayyyy over the limit. It is typically a manditory liscence suspension and misdimeanor charge, however if you blow a high enough BAC it becomes a felony (so refusal can keep it misdemeanor).

The only true way that I know to get out of a DUI/DWI is (DWI has become synonimous with Alcohol and DUI has been used for under the influence of anyhting in Mass), before the cops puts his/her lights on, shut off the car, keys on the floor, get out and lock the doors. Then when the cop asks what you are doing, say I just realized I should not be on the road, they will give you public drunkeness and abandonment of a vehicle (and a ride home or to the drunk tank).

As far as Accidents (like bumping a parked car, little accidents), leave the scene (I know this sounds fucked up), go call the cops report the accident (to avoid the leaving the scene charge), then hit up a bar and walk back to the scene. You then have witnesses about you having a drink at the bar, and they cannot proove you were drunk at the time of the accident.

If you have had too much to drive and feel like passing out, DO NOT PUT YOU KEYS IN THE IGNITION, put em on the floor, and lock the doors. If the keys are in the ignition they can get you for OUI (Operating under the influence) with the car running or shut-off.

These are not easy to get away with, so best bet, if you are drunk, don't drive.


A lesson for all you kiddies out there. Going out drinking until 4:30 is a bad idea when you have to be up for work at 7:30.

Wow with this new found information I'm going out drinking and driving. I was wondering how you get away with it??? I have a family that is on the rode PLEASE DO NOT DRINK and DRIVE. No good can come of it, if your lucky you'll only lose your driving priviledges if your not lucky you could end up killing somebody sounds like a game with alot of downsides.

u could always just refuse the breathalizer
in ohio, the laws is that if u refuse, the police can take your liscense
so if your with somebody whos sober, u can refuse and then show up to court after sobering up
but if thats the case, they should be driving in the first place =|
