check your state's and county's drug testing laws. There are a number of states that don't permit drug testing unless the employee is made aware of drug testing at the time of hiring. In addition, a number of companies aren't allowed to drug test unless they can prove a history of less than satisfactory work productivity, etc. Finally, if your state was one of the weird ones (I think VT did it) that banned drug testing then turned around and said you can drug test, but the employee must be told at time of hire, those who were hired before that law went into affect can't be tested (in some cases, under no circumstances...even with poor job performance)>
